Copyright Policy

Magnus respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (the “DMCA”), Magnus will respond expeditiously to claims of copyright infringement reported to its Designated Copyright Agent as set forth below.

If you are a copyright owner, or are authorized to act on behalf of one, you may report alleged copyright infringement occurring on or through the Service by submitting a DMCA Notice of Alleged Infringement (“Notice”) to Magnus’ Designated Copyright Agent.

Upon receipt of a valid Notice, Magnus will take such action as it deems appropriate in its sole discretion, including removal of, or disabling access to, the allegedly infringing material. Magnus may also take reasonable steps to address additional instances of the identified material where such instances are reasonably identifiable based on the information provided. Magnus does not guarantee the identification or removal of all possible variations, modifications, or derivatives of such material.

Magnus operates as a service provider within the meaning of the DMCA and does not pre-screen content. Content made available through the Service may originate from users, third parties, or publicly available sources, and Magnus does not claim ownership of such content. Magnus has no obligation to monitor content on the Service but reserves the right to review, remove, or disable access to content at its sole discretion.
Nothing in this policy shall be construed as an admission of infringement or liability by Magnus.

DMCA Notice of Alleged Infringement
To submit a Notice, please provide the following information:

  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single Notice, a representative list of such works;
  • Identification of the material that is claimed to be infringing (or to be the subject of infringing activity) and information reasonably sufficient to permit Magnus to locate the material, including, where applicable, the specific URL or location on the Service;
  • Your mailing address, telephone number, and, if available, your email address;
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information in the Notice is accurate and that you are authorized to act on behalf of the copyright owner; and
  • Your physical or electronic signature.

If the work identified in your Notice is an image or visual work, you may request removal of the material containing such image by clearly identifying the relevant material in your Notice. Removal of material pursuant to a valid Notice applies to the specific content identified in the Notice and does not extend to underlying factual information associated with such content that is not subject to copyright protection (for example pricing information).

Repeat Infringer Policy
Magnus may, in appropriate circumstances and at its sole discretion, limit or terminate access to the Service for users who are determined to be repeat infringers.

Counter-Notification
If you believe that material has been removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to Magnus’ Designated Copyright Agent.
A valid counter-notification must include:

  • Your name, address, and telephone number;
  • Identification of the material that has been removed and the location at which it appeared before removal;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification;
  • A statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or, if outside the United States, any jurisdiction in which Magnus may be found); and
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, Magnus may restore the material in accordance with applicable law.
